UPDATE 11.18.08
This went to court in Orange County CA today. I had sent the proper documents to request it be dismissed since much of the  the information on the suit is false, and I don’t even live in CA. I don’t know what happened in the court room, but the plaintiff was there and must have lied some more because they refused to change it, and rescheduled another trail date.

I keep trying to contact Amazon about this, but can’t seem to get them to take notice. It’s pretty crazy. Looks like I’m back at square one.

Trying not to be down about this, but it’s frustrating. It’s not just about paying $36. It the fact that this is a scam. He’d demanding than $36.00. It’s more like $200 so that I can pay his court fee’s etc… Sigh

No, not kidding. This may sound like I’m making up a good story but it’s true. Funny in a way (or will be when I look back) but it’s also super annoying.

Here’s the story. A few months back I ordered some specific Canon OEM ink cartridges from Amazon.com. If you use Amazon much you know that when you look up a specific item there’s a list of various Amazon sellers to buy the item from. Anyway I ordered what I needed from an Amazon seller called MAAK Enterprises. When I got the package it turns out not to be the ink I ordered but a cheap imitation. Long story short I went thru Amazon’s A-Z satisfaction policy and they got me a refund.

I even told the seller if they sent a call tag for this junk I would return it. They didn’t send one, though they did send an email saying I was now in possession of stolen property and they would call the local police if it was not returned. I asked them to record the call to the police because I wanted to hear them explaining it to the people at the station who know me.

So Today I get served (yep the process server actually tracked me down) with a small claims suit for $36.75. I had been told he was looking for me. Not only that, but the plaintiff lied on the filing saying that I do business in Orange County CA, even though I’m in Washington. This makes the case in Orange County CA. In order to get it changed I have to go thru the process of sending the right forms and try to get a case relocation granted. I’m also told by the small claims court that if I ignore the case the suit can default, and if I don’t pay it will go on my credit.

Now I realize this is all stupid. The seller probably just did it to trouble me because I left a bad rating for them. I’m sure I could get this moved locally, but now I have to waste my time because of this unprofessional company. Since all the charges actually came thru Amazon I’m going to contact them and try to get them to deal with it.

So here I sit on Orange County Calif lawsuit papers and  a four of inkjet cartridges. Oh did I monition that the day I got the ink I had to use one of them because I was out and needed a print. I told Amazon they could charge me for the one used, so the refund I received was for $28.80. Wait… I’m being sued for $7.95 more than I was refunded.
